Insolvency

As of 6th April 2015 a new law has come into force that has an impact on Insolvencies and how companies are de-constructed. CDM 2015 dictates that most Insolvencies, Restructuring and Administrations will require a “Principal Designer” to manage the Health and Safety of the said appointments. This “New” professional body is required at the early planning stages, preferably before an Agent has been appointed. The Principal Designer will then oversee the project through to its completion.

An Insolvency Practitioner is subject to the appointment of a Principal Designer if they are to undertake (but not limited to) – “Site Clearance and the clearance or preparation of the site or structure for use or occupation at its conclusion” and  “the installation, commissioning, maintenance, repair or removal of mechanical, electrical, gas, compressed air, hydraulic, telecommunications, computer or similar services which are normally fixed within or to a structure,”
